PRIVACY NOTICE FOR MODELING SERVICES

In compliance with the applicable law on the protection of personal data ("Applicable Privacy Law"), Yves Saint Laurent, with registered office at 37-39 rue de Bellechasse, 75007 Paris, France, in its quality as data controller ("YSL", "Data Controller", "we", "us" or "our"), wishes to inform you about the processing of personal data in the context of modeling services.

Personal Data and Data Sources

YSL collects personal data from agencies, casting directors and models when they fill in forms or communicate with us by other means.

For the avoidance of doubt, personal data means any information relating to an identified or identifiable natural person and may include sensitive data such as health data, as specified below ("Personal Data").

Personal Data mainly include:

  • Data concerning agencies: agency staff, officer and director names and contact details (addresses, telephone numbers, email addresses); related correspondence; relevant employment forms; declaration of secondment, where applicable; agency vouchers; agreements such as right to image assignments, and confidentiality and loyalty agreements.

  • Data concerning models: model names, addresses, model ages, size and other body measurements, model images and/or videos; copies of identity documents; copies of visas or residence permits where applicable; recent (less than six months' old) medical certificates; relevant employment forms, declaration of secondment, where applicable; agency vouchers; agreements such as right to image assignments, and confidentiality and loyalty agreements.

This Personal Data is required by law or, otherwise, to enter into or perform a contract with an agency or a model. Failure to provide any information may prevent us from entering into or fulfilling such contract.

This Personal Data is collected and managed in accordance with YSL's instructions and security safeguards.

Purposes and Legal Bases of the Processing

We collect personal data directly in France for the purposes of engaging agencies and models for services in connection with casting, fitting, fashion shows, showrooms or related events and promotional campaigns that we organize or that involve our Brand.

When we process personal data for the purposes described above, we rely on the following legal bases when applicable:

  • the processing is necessary for compliance with a legal obligation to which we are subject (notably verifying eligibility for employment, obtaining medical certificates, verifying registration certificates, employment conditions and/or work permits, and any other legal obligation which is related to the performance of a contract for modeling services), in compliance with the Applicable Privacy Law;

  • the processing is necessary to take steps at the individual's request prior to entering into a contract (notably verifying qualifications and work history) and for the performance of a contract itself to which the individual is a party, in compliance with the Applicable Privacy Law; when the individual is not a party, the counter-party shall ensure the compliance on proper legal bases including consent when before the provision of the personal data to us.

In addition, the Data Controller may also process your Personal Data collected through the engaging agencies, if needed, in order to (i) comply with legal requirements, or orders, decisions and measures issued by competent Authorities and (ii) to establish, exercise or defend its rights before competent Courts, according to the Applicable Privacy Law.

Access and Sharing of Personal Data

Personal Data will be accessible only by specific authorized personnel acting under the authority of the Data Controller, and affiliated companies, duly instructed to process the data.

Data may also be shared with YSL 's service providers, acting as data processors, in accordance with YSL's instructions and security safeguards. Such personnel and service providers are located in the country where the agency is engaged. A list of providers used by YSL, is available upon request by writing at privacy@ysl.com

Finally, whenever required, your data may also be disclosed to third parties to comply with legal obligations and/or requests from competent authorities.

Data Retention

Our general rule is to keep personal data only for as long as required to fulfil the purposes for which it was collected. Consequently, we retain personal data for a period of time corresponding to one or more statutes of limitation periods during which legal claims may be filed in court, or corresponding to a period during which we are required by employment, tax or accounting laws to retain personal data, or if required to do so by a legal authority, or other governmental entity.

In general, agency and model contracts and related documentation and correspondence are retained for five (5) years after the termination or expiration of the contract.

Medical certificates and information regarding appearance (size, measurements, hair and eye color and similar information) is retained up to six (6) months.

After the retention period, we will destroy personal information recorded and stored in electronic files in an irrevocable manner, and shred or incinerate personal information recorded and stored in paper documents

Transfer of Personal Data

Unless there is a legal obligation to disclose Personal Data to competent Authorities or other third parties or unless it becomes strictly necessary for the establishment, exercise or defense of Data Controller's legal claims, your Personal Data will not be transferred outside the European Economic Area ("EEA").

If, for any reason, this situation changes in the future, we will notify you and ensure that the recipient is subject to security and data protection standards at least equivalent to those guaranteed under this privacy notice (e.g. by signing the Standard Contractual Clauses).

Your Rights Regarding Your Personal Data

You can exercise your rights under Applicable Privacy Laws at any time and YSL will not discriminate you for exercising such rights.

Under Applicable Privacy Laws, you may request:

  • (i) the confirmation whether or not we process your personal data and, if this is the case, to access it, including receiving a copy of all the data (right to know and access);

  • (ii) the correction and/or updating of your personal data (right to rectification);

  • (iii) the deletion of your data (right to erasure), in the cases provided for by applicable law;

  • (iv) a temporary suspension of the processing of your data (right to restriction), when permitted by the law in force;

  • (v) the portability of your personal data, by receiving it in a structured, commonly used, machine-readable format and requesting, where technically feasible, its direct transmission to another data controller;

  • (vi) right to object to the processing of your personal data, when based on the YSL's legitimate interest.

You may also lodge a complaint with the competent Authorities.
